And the title of the article says "dev kits".

Its illegal to go through someones trash here...invasion of privacy, the police would need to wait until it reaches the city dump, even a garbage man can get in trouble for not making sure it reaches the destination untouched. Not like anyone cares or abides by it...but by law it is.Just one more thing may be intereseting pointing out.

rare video games can mean both about consoles/handhelds or the games.
if you saw/read the articles there are pics of both consoles(dev kits or not) maybe with old firmwares
and prototypes or unfinished games.
These can easily be classified as rare.

Now if you are referring to prototypes being sold for the company that produced them,

My guess sega was the faulty one here. Probably they didnt realiaze their mistake
until they saw the sale annoucement.

They may have hired someone one to disposal read destroy them
but someone instead sold to the guy. In this case he bought some "stolen" products.

If someone signed a confidentiality agreement in which he agreed not to sell them, that's not my problem. Let them take him to court. I bought them legally.
And, if they didn't agree with that, the logical thing would be to report him to a judge, not send police to his house as if he were a criminal and steal everything to possibly destroy it.
